Hello Gurus,
Can we use an Existing Adv. parole Document that was stamped at the POE this year be used Again for Travel Purpose. It has a Valid date and expires in September '08. I am planning to visit europe next week and i couldn't find the 2nd AP Document that was never used.

Wondering if a little something when filing my taxes will backfire on me when filing I-140/485.
I'm single/no dependents but for past 4 yrs or so when filing taxes have showed 2 dependents for child tax credit (no earned income credit applied for)....my niece/nephew. My bro had full knowledge and he had suggested as due to his status in US, he is not required to file taxes. Sis in law not working, so not filing taxes. So i used to do that....
It won't come to bite me right???? ok i am never doing this from now on but is it too late for me. Obviously on my immigation forms i will show no dependents etc as i have none...
any advice.....

You are wrong.. all the applications will go to Atlanta processing center irrespective of company's location..
Right now Atlanta Processing Center processing May 2008 priority date for clean cases....for audited cases July 2007...
It's not true that all the cases will got to Atlanta Processing Center ...if any case that has been auidted will be moved to Atlanta Processing Center.

AFAIK those who filed after July 30, 2007 filed with the new fee, and do not have to pay the fee for the EAD. However you can't e-file, but have to send in your paper application form.

Like many others, I was also unable to file my I-485 after the July 2 fiasco. My lawyer front-desked my application yesterday to ensure my eligibility for the class action. But he sent my application to the Texas Service Center instead of the Nebraska Service Center as was insructed in the form. Also, my employment letter was addressed to the Nebraska Service Center. His reasoning: my I-140 was approved by the Texas Service Center. Also, my name was spelt wrong on the FEDEX tracking system. Will USCIS reject it because of filing at the wrong service center...if so then will I lose my class status? Please shed some light.

We are planning to register a LLC and run the franchise on the company. Let me know if I have to take any precautions before buying the franchise..
Also let me know if my friend can be my partner on H1.b..
You can own and work for your LLC. Your H1b friend can be a partner, but he cannot work for the LLC, he can have his share of profits though. You need to confirm this with a lawyer before you register your LLC.

If you are efiling EAD, you dont have to send photo graphs - USCIS will send FP notice to take a picture. That picture will appear on your EAD.
It is required that you send photos for your ead as they put your picture on the actual ead card. I did not apply for AP so I am not sure about the requirements for that. Good luck to you.

My client is trying to see if there are any possibilities to bring a graphic artist - flash developer from Phillipines, he currently works freelance and has made a big impression with his work. He has shown interest to come to US on h1b and company wants to know if they have any issues in bringing him onboard by sponsering a h1b. The issue is, he does not have college education, other than that, he qualifies excellent for a job in this company. Will he have issues in getting a h1b? Has anyone got H1b visas with college degrees but only with work experience?

My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

You PD has to be current to file I-485 for you spouse/dependent. Since you filed for I-485 in Jun '05, and based on ur PD, i guess ur case must be EB2. If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

Watch for April VISA BULLETIN, The DOS publishes this ususally sometime in first 2 weeks of each month for the following month. If the Date moves forward you should be able to file sometime in April, assuming the Date moves forward. Also you can use this time to prepare the application.

No transit visa needed if you are using AP.
If you are using H1B and you dont have a valid stamp on your passport, then you need to verify.

I am in a strange situation.
My attorney is about to file my I-1485 this week.
My details:
Previous company:
Perm PD: June 2006 EB2
I-140 EB2 approved in Nov/2006.
Current company:
PERM filed: Oct/24/2007
I-140 EB2 filed on Jan/31/2008
trying to recapture the old PD of June/2006.
Today, when I checked my I-140 status, it says "Request for Evidence sent" yesterday.
What are my options now? I do not know if I am eligible to go ahead and file my I-485 now ? What are the implications if I go ahead and file my I-485 now.? Please let me know your ideas.

An A# is allotted whenever you file for AOS (either employment or relationship based or any other category eligible) and the USCIS accepts your I-485. This will be your A# for the rest of your life and will be on any subsequent filings (irrespective of the category .. immigrant or non-immigrant) with the USCIS.
I am not really sure about the A# allotted when you file for F1/OPT (I never had an F1). Please check with a qualified legal specialist.

I have seen previous forums stating that OPT A#s begin with a "1" which connotes an OPT status; however I am not clear whether we are supposed to use that same A# on our I-485 and other GC-related documents, or leave that space blank.
Sorry this is redundant but previous posts don't seem to clarify a definitive answer to this question. Many thanks in advance.

Complete your profile first. How come your GC is not approved if your PD is Nov'02 with EB-2 India....Is your I-140 approved and I-485 pending for more than 180 days? If so, it doesn't matter if your employer revokes I-140, you will be covered under AC21, provided you have another job offer in a same/similar position.
