I did the same thing.
I filed first I-485 on July 6th, but my attorney said that they had messed something up...and need to file second I-485. Second set was filled around August 14th
I received all my receipts as well as EAD from first filling.
So my attorney asked to put stop payment on checks from second I-485, so now when USCIS asks for money...she will withdraw the second case at that time.
Should this work...???

hi guys,
i have a 485 filing question. i'm on EB2, ready to file for 485. however, i am in india on a family matter and will have to return only for the filing. i know it is "sooner the better", but i am trying to figure out how late i can return to US.
i have read on this forum that dates will retrogress in august. any informed people out there know how likely that is?
also, if i have to make it there in july to file 485, any idea about how long after filing i need to stay in the US before i can return back to india? i mean, any rules which say you cannot travel before such-and-such happens?

In a recent decision, RUIZ-DIAZ v. Hi,
My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. A good way to highlight our plight is to write to business magazines/research journals.
Anyone with a business idea or is a researcher and are being held back because of this retrogression, approach and write to business magazines or research journals. Even a simple email asking suggestions on your situation and if there is any work around might help.
Every city has a few local business magazines and these very much influence the local elected representatives.
The more our plight is published, the better.
And remember we eventually might influence the local politics one day with our contributions!

I think you are required to have passport valid atleast 6months after your interview

Your Employer letter should be sufficient to support your wife from your employer,u don't need any other stuff,you can also tell your attorney about the form I-134 for Affadavit for support thats all you need,everything should be ok,don't worry be happy.

Unfortunately, by mistake LCA stating dates from 07/31/2007 to 07/30/2010.
but I am only qualify upto 06/30/2010 as per 6 year H1B limit.
Atty, told me that 1-129 going to file upto 06/30/2010.
Is it o.k.
I will appreciate your input!

You can file an amendment. Mistakes is so common at USCIS.
If you dont want to, I think you can recapture your unused time on h1b and get h1b for extended period based on time not in the US. Check with attorney and see if you can get h1b extension for all the time you were not in US.

I think she is ok, getting an H1-B approval doesn't mean that you have to start immediately. for e.g, many of the Indian tech companies get an H1-B at the start of the year and when they have a need for that person in US, send him/her over.
Only after her first payroll would she be considered on H1-B.

I am from PA. I am a June filer. My wife who is a primary applicant, got EAD for her and our son in the first week of Aug(after finger printing). I did not get my EAD so far. I had been to Philadelphia after getting INFOPASS appointment last week. Nothing happened there, just waste of time! It seems that there are no rules/ regulations in this system. Many of my friends got their EAD before FP. One of my friends got his GC without I-140 approval. The whole GC system is in big mess.

Now, the question I have is how expensive is it to transfer the H1B and can the candidate travel during the transfer?
